These Terms and Conditions (“Terms”) govern your use of the brand2chat.com website and live chat platform (the “Service”) operated by Light 2 Speed Private Limited (“us,” “we,” or “our”).

Please carefully read these Terms before using the Service.

Your access to and use of the Service is contingent upon your acceptance and compliance with these Terms. These Terms apply to all visitors, users, agents, and others who access or use the Service.

By accessing or using the Service, you agree to abide by these Terms. If you disagree with any part of these Terms, please refrain from accessing the Service.

Eligibility

To use Brand2Chat, you must be at least 18 years of age and have the legal authority to enter into a binding agreement on behalf of yourself or the business you represent. By creating an account, you confirm that all information you provide is accurate, current, and complete, and that you are using the Service for legitimate business purposes.

Brand2Chat is intended for business use only. Use of the Service for personal, household, or non-commercial purposes is not permitted. We reserve the right to refuse access to any individual or entity that we determine, at our sole discretion, does not meet these eligibility requirements.

Accounts

When creating an account, you must provide accurate, complete, and current information. Failing to do so is considered a breach of these Terms and may result in the immediate termination of your account.

You are responsible for safeguarding your account password and for all activity that occurs under your account. Do not share your password with others, and inform us immediately of any unauthorized account use or security breaches at support@brand2chat.com.

You may not use a username that is not lawfully available for use, a name or trademark subject to another entity’s rights without proper authorization, or a name that is offensive, vulgar, or obscene.

You are solely responsible for ensuring that your team members, agents, and any other individuals who access Brand2Chat through your account comply with these Terms. Any violation of these Terms by a member of your team will be treated as a violation by your account.

Free Plan

Brand2Chat offers a free forever plan (“Free Plan”) that gives businesses access to core live chat features at no cost and with no time limit. The Free Plan does not require a credit card to activate.

The Free Plan includes a branded chat widget, unlimited agents, and a shared team inbox. Certain advanced features including AI-powered replies, deep analytics, multi-site support, and priority customer support are available only on paid plans.

Brand2Chat reserves the right to modify the features included in the Free Plan at any time. Where changes to the Free Plan reduce existing functionality, Brand2Chat will provide reasonable notice to affected users before the changes take effect.

Subscriptions

Certain advanced features of the Service are available through paid subscription plans (“Subscriptions”). Subscriptions are billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles may be set on a monthly or annual basis, depending on the chosen subscription plan.

Your Subscription will automatically renew under the same conditions at the end of each Billing Cycle, unless you cancel it or Brand2Chat cancels it. You have the option to cancel the Subscription renewal through your online account management page or by contacting Brand2Chat’s customer support.

To process Subscription payments, you must provide valid payment information such as credit or debit card details. By providing such payment information, you authorize Brand2Chat to charge all Subscription fees to your account through the provided payment method.

In cases where automatic billing fails, Brand2Chat will send an electronic invoice that must be paid manually within a specified deadline, covering the corresponding billing period.

Fee Changes

Brand2Chat may, at its discretion and at any time, adjust Subscription fees for the Subscriptions. Any changes in Subscription fees will take effect at the end of the current Billing Cycle.

Prior to a change in Subscription fees, Brand2Chat will provide reasonable notice to allow you to terminate your Subscription before the new fees apply. Continuing to use the Service after the fee change constitutes your agreement to pay the modified Subscription fee amount.

Refunds

Brand2Chat may consider specific refund requests for Subscriptions on a case-by-case basis, subject to Brand2Chat’s sole discretion.

Refunds will be transferred to the original payment method within 5 to 10 working days.

Acceptable Use Policy

You agree to use Brand2Chat only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the Service. You must not use Brand2Chat to:

  • Send spam, unsolicited messages, or bulk promotional content to website visitors through the chat widget
  • Collect sensitive personal data from visitors without proper disclosure or consent
  • Engage in any activity that is fraudulent, misleading, deceptive, or harmful
  • Upload or transmit any content that is abusive, threatening, defamatory, obscene, or otherwise objectionable
  • Attempt to gain unauthorized access to any part of the Service, its servers, or any connected systems
  • Attempt to reverse engineer, decompile, disassemble, or derive the source code of the Service
  • Use the Service to develop a competing product or service
  • Resell or commercially redistribute access to the Service without prior written permission from Brand2Chat
  • Interfere with or disrupt the integrity, security, or performance of the Service
  • Deploy automated systems including bots, spiders, or scrapers that generate excessive requests to Brand2Chat’s servers

Brand2Chat reserves the right to suspend or terminate any account found to be in violation of this Acceptable Use Policy without prior notice.

Widget Installation and Use

By installing the Brand2Chat widget on your website, you take full responsibility for how the widget is used on your platform. You are responsible for ensuring that your use of the widget complies with all applicable laws and regulations in your jurisdiction, including data protection and privacy laws.

You must inform your website visitors that a live chat tool is active on your website and that conversations may be recorded or stored. You must not use the Brand2Chat widget to collect sensitive personal information such as passwords, payment card details, or government identification numbers through the chat interface.

Brand2Chat is not responsible for any claims, damages, or losses arising from how you install, configure, or use the widget on your website.

Data Collection and Privacy

Brand2Chat collects certain data from users and from visitors who interact with the chat widget installed on your website. This includes but is not limited to chat conversation content, visitor IP addresses, browser information, and contact details submitted through the chat.

As the business installing Brand2Chat on your website, you act as the data controller for your visitors’ data. Brand2Chat acts as a data processor on your behalf. You are responsible for ensuring that your website’s privacy policy informs visitors about the use of live chat and the data it collects.

Brand2Chat handles all data in accordance with its Privacy Policy, which is available at brand2chat.com/privacy-policy . By using the Service, you agree to the terms of the Privacy Policy.

Intellectual Property

The Service and all of its original content, features, functionality, code, design, and branding are and will remain the exclusive property of Light 2 Speed Private Limited. You may not copy, reproduce, distribute, modify, create derivative works of, or commercially exploit any part of the Service without prior written permission from Brand2Chat.

You retain full ownership of the chat content and customer data generated through your use of Brand2Chat. By using the Service, you grant Brand2Chat a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you.

Brand2Chat grants you a limited, non-exclusive, non-transferable, revocable license to install and use the chat widget on your website in accordance with these Terms.

White Label and Agency Use

Agencies and freelancers who use Brand2Chat to manage live chat on behalf of their clients may customize the widget with their client’s branding including colors, logo, and agent names. This is permitted within the bounds of the applicable subscription plan.

Agencies are fully responsible for ensuring that their clients’ use of Brand2Chat complies with these Terms. Any violation by a client managed through an agency account will be treated as a violation by the agency account holder.

You may not sublicense, resell, rent, or commercially redistribute access to Brand2Chat or any part of the Service to third parties without prior written authorization from Brand2Chat.

Third Party Integrations

Brand2Chat may allow you to connect third-party tools and services to the platform including CRMs, helpdesks, and messaging platforms. Brand2Chat is not responsible for the availability, accuracy, security, or performance of any third-party integrations.

By connecting a third-party service to Brand2Chat, you agree that Brand2Chat may share relevant data with that service as required to enable the integration. You are responsible for reviewing and complying with the terms and privacy policies of any third-party services you connect.

Service Availability

Brand2Chat aims to provide a reliable and continuously available service. However, we do not guarantee uninterrupted access to the Service. Planned maintenance, updates, or circumstances beyond our control may occasionally result in temporary downtime.

Where planned maintenance is expected to cause significant disruption, Brand2Chat will make reasonable efforts to notify users in advance. Brand2Chat is not liable for any loss of business, revenue, or data arising from service interruptions or downtime.

Limitation of Liability

To the fullest extent permitted by applicable law, Light 2 Speed Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption arising out of or in connection with your use of the Service.

Brand2Chat’s total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount paid by you to Brand2Chat in the three months preceding the claim, or the equivalent of one month’s subscription fee, whichever is lower. For users on the Free Plan, Brand2Chat’s total liability shall not exceed the amount of fifty US dollars.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.

Termination

You may close your Brand2Chat account at any time by visiting your account settings or by contacting us at support@brand2chat.com. Upon closure of your account, your access to the Service will be revoked immediately.

Brand2Chat reserves the right to suspend or terminate your account at any time and without prior notice if you are found to be in violation of these Terms, if your account is involved in fraudulent or abusive activity, or if continued access poses a risk to the Service or other users.

Upon termination of your account, your chat data and account information will be retained for a period of 30 days before being permanently deleted, unless a longer retention period is required by law. You may request an export of your data before your account is closed.

Changes to Terms

Brand2Chat reserves the right to update or modify these Terms at any time. Where changes are material, we will notify you by email or by displaying a prominent notice within the platform at least 14 days before the changes take effect.

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service before the changes take effect.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
